Today, the Division of Corporation Finance spoke in the form of a statement on liquid staking activities that purports “to provide greater clarity on the application of the federal securities laws to crypto assets.”[1] But instead of clarifying the legal landscape, today’s statement, like other recent staff statements before it, only muddies the waters.[2]

Federal Reserve Board And FDIC Release Public Sections Of Resolution Plans For Banking Organizations

The Federal Reserve Board and the Federal Deposit Insurance Corporation (FDIC) today released the public sections of resolution plans for the eight largest and most complex domestic banking organizations and 56 foreign banking organizations. These banks were required to submit resolution plans by July 1, 2025.

Introduction
As part of an effort to provide greater clarity on the application of the federal securities laws to crypto assets, the Division of Corporation Finance is providing its views on a specific type of Protocol Staking. The Division previously provided its views on certain types of Protocol Staking in a staff statement (the “Protocol Staking Statement”), which addressed three types of Protocol Staking: self (or solo) staking; self-custodial staking directly with a third party; and so-called “custodial staking.” This statement addresses a fourth type of Protocol Staking known as “liquid staking.”
